Terms of Service

These terms are an agreement between you and Alessandro Alberga ("we", "us"), an individual developer based in New South Wales, Australia, and govern your use of the FluenSi app and the fluensiapp.com website (together, "FluenSi"). By creating an account or using FluenSi, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use FluenSi.

1. Who can use FluenSi

You must be at least 13 years old, or older if your country requires a higher minimum age. If you are under 18, you need permission from a parent or guardian, who agrees to these terms on your behalf.

2. Your account

You are responsible for your account and everything that happens under it. Keep your sign-in details secure, give accurate information, and tell us at support@fluensiapp.com if you think someone else has accessed your account. Accounts are personal and may not be shared or transferred.

3. Free trial and subscriptions

• Free trial. New accounts get 24 hours of full access, starting from your first translation. When the trial ends you need a subscription to keep using FluenSi.
• Plans. FluenSi Basic includes daily limits on new words, reviews and translations, shown in the app. FluenSi Pro has no daily limits. Current prices are shown in the app and the App Store or Google Play, in your local currency, before you buy.
• Billing and renewal. Subscriptions are purchased and billed through the Apple App Store or Google Play. They renew automatically at the end of each billing period, and your store account is charged, unless you cancel at least 24 hours before the current period ends.
• Cancelling. You can cancel any time in your App Store or Google Play account settings. You keep access until the end of the period you have paid for. Deleting the app or your account does not cancel a subscription.
• Refunds. Refunds are handled by Apple or Google under their own refund policies. Except where the law requires otherwise, we don't give refunds or credits for partial periods.
• Changes. We may change prices, plans or what each plan includes. We will give you reasonable notice of any price increase, which applies from your next renewal and follows the store's rules, so you can cancel before it takes effect.

4. Acceptable use

FluenSi is for personal, non-commercial language learning. You agree not to:

• break the law or infringe anyone's rights while using FluenSi;
• get around usage limits, subscription checks or security measures;
• use bots, scripts or modified versions of the app to access our services;
• copy, resell, reverse engineer or build a competing service from FluenSi, except as the law allows;
• upload harmful, unlawful or abusive content, or try to disrupt or overload our services.

5. Your content

You own the words, sentences, notes and other content you add to FluenSi. You give us a worldwide, non-exclusive, royalty-free licence to store, process and transmit that content (including to the service providers listed in our Privacy Policy) only as needed to provide and improve FluenSi for you. You are responsible for your content and must have the right to use it.

6. Translations, analysis and feedback

Translations, word analysis, example sentences and sentence feedback are generated automatically using machine translation and AI, and may be incomplete or wrong. They are for learning only. Don't rely on them for important, legal, medical or official purposes, or as a certified translation.

7. Our intellectual property

FluenSi, including the app, website, design, branding and our own content, belongs to us and our licensors. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own learning, in line with these terms.

8. Third-party services

FluenSi relies on third-party services such as Apple, Google and our payment and hosting providers. Your use of their services is also subject to their own terms. We are not responsible for third-party services we don't control.

9. Availability and changes

We work to keep FluenSi available and reliable, but it may sometimes be unavailable for maintenance or reasons outside our control. We may add, change or remove features over time. If we discontinue FluenSi entirely, we will give reasonable notice where we can.

10. Ending your use

You can stop using FluenSi at any time and delete your account in the app, under Account (see our Privacy Policy). We may suspend or close your account if you seriously or repeatedly break these terms, misuse the service, or if the law requires it. Where reasonable, we will tell you first. Sections 5 to 7 and 11 to 15 continue to apply after your account ends.

11. Consumer rights

Nothing in these terms excludes, restricts or changes rights you have under the Australian Consumer Law or other consumer protection laws that cannot be excluded. If you are a consumer in the EU, UK or another country, you also keep the mandatory rights your local law gives you.

12. Disclaimer

Except for the rights in section 11, FluenSi is provided "as is" and "as available". To the extent permitted by law, we don't promise that FluenSi will be uninterrupted, error-free, or that it will help you reach any particular level in a language.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for loss of data, profits or opportunity, arising from your use of FluenSi. Our total liability for any claim relating to FluenSi is limited to the amount you paid for your subscription in the 12 months before the claim, or AUD $50 if you haven't paid anything. Where the Australian Consumer Law applies and our liability can be limited, it is limited to supplying the services again or paying the cost of having them supplied again.

14. Apple App Store terms

If you downloaded FluenSi from the Apple App Store, the following also applies:

• These terms are between you and Alessandro Alberga only, not Apple. We, not Apple, are solely responsible for FluenSi and its content.
• Your licence to use FluenSi is limited to Apple-branded devices you own or control, as allowed by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for FluenSi.
• If FluenSi fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the extent permitted by law, Apple has no other warranty obligation for FluenSi.
• We, not Apple, are responsible for addressing any claims relating to FluenSi, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• We, not Apple, are responsible for investigating and defending any claim that FluenSi infringes someone's intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia. If you are a consumer living elsewhere, you may also have the right to bring a claim in your local courts under your local law.

16. Changes to these terms

We may update these terms from time to time. If we make material changes, we will update the date above and tell you in the app before they take effect. If you keep using FluenSi after the changes take effect, you accept the updated terms.
